Introduction
Thank you for your interest in FanServ! We know that your privacy is important to you, and we take our responsibility to safeguard your information very seriously. If you are a customer of FanServ or a developer using our SDK, these terms apply to your use of the FanServ Services. If you are an End User, these terms will help you understand how FanServ may collect certain information about your use of our websites, mobile devices and mobile applications. Please read this Privacy Policy carefully. This Privacy Policy may change from time to time and your continued use of the Services and/or our websites or mobile applications constitutes acceptance of such changes, so please check this area periodically for updates.
Overview
FanServ collects anonymous data about websites, mobile devices and applications on behalf of our Customers in order to enable them to deliver advertisements, products, and services that are relevant and meaningful to their End Users. We do not collect any Personally Identifiable Information from End Users, only interest and behavioral data tied to anonymous, resettable, and opt-out-enabled website and device advertising identifiers. We support and adhere to all applicable industry self-regulatory programs, principles, and guidance published by the Network Advertising Initiative (NAI), the Digital Advertising Alliance (DAA), and the Interactive Advertising Bureau (IAB). In accordance with these regulatory guidelines, FanServ requires website and app publishers installing the FanServ SDK to provide a clear, meaningful, and prominent notice to End Users of their website and/or application regarding FanServ’s collection and use of anonymous data from the app and the End User’s device, and to gain consent from End Users for this data collection. We also offer choice to End Users through opt-out mechanisms enabled directly on a user’s device settings and via the FanServ opt-out page: http://fanserv.com/opt_out_policy.
Definitions
The following is a non-exhaustive list of definitions of words and phrases found in this document:
“Analytics Services” refers to usage of data visualization and analysis tools and reports made available to Customers through a secure user interface or via authorized distributed reports characterizing and containing aggregated User Data.
“Customer” refers to website and/or app owners, developers, marketers, or agencies making use of FanServ Services, or having signed up for FanServ Services via our Site or mobile applications
“Customer Data” refers to any data collected during registration as a FanServ Customer or provided by FanServ Customers through the use of FanServ Services. This may include Personally Identifiable Information such as name, mailing address, email address, phone number, and payment information
“Personally Identifiable Information” is information about a specific individual including name, address, telephone number, and email address — when used to identify a particular individual.
“End Users” refers to users of our websites and/or mobile applications
“FanServ” refers to B3Connect, LLC dba FanServ
“FanServ SDK” refers to the code available to app developers to install within a website and/or app to enable the collection and analytics of User Data
“Services” refers to either Analytics Services or Targeted Advertising Services, or both
“Site” refers to our website, www.Fanserv.com
“Targeted Advertising Services” refers to the use of collected and aggregated User Data to deliver targeted and relevant advertisements
“User Data” refers to non-personally identifiable characteristics and behaviors of End Users
Information Collected
Identifying Information
We do not collect any Personally Identifiable Information from End Users.
If you are a Customer with an account, we collect certain personal information from you when you sign up for our Services that can be used to identify you, such as your name, email address, mailing address, phone number, and payment information.
Non-Identifying Information
If you are an End User, FanServ may collect non-identifying information about your device through your interaction with certain websites and/or mobile apps and advertisements, including device attributes such as: operating system, hardware version, device settings, IP address, time zone, device carrier, applications installed on the device, and device advertising identifiers. We may also collect certain demographic information (such as age, gender, territory) and information about End User behavior when using a Customer’s mobile application. If you have enabled location tracking in your application, we may receive certain location information about your device. We do not collect any Personally Identifiable Information (name, address, email address, etc.) about you. Whenever you visit our Site or use our mobile applications, we may collect non-identifying information from you, such as your IP address, referring URL, browser, operating system, cookie information, and Internet Service Provider. Without a subpoena, voluntary compliance on the part of your Internet Service Provider, or additional records from a third party, this information alone cannot usually be used to identify you.
If you are a Customer who uses the Services in connection with your website and/or mobile applications, we collect certain usage data about the operation of your website and/or applications, the mobile devices that run your applications, and user interactions with your website, and with your applications and certain other applications on the device. We do not collect information that can be used to identify an individual, except on an anonymous basis.
Use of Your Information
We may use the information we collect to enhance or improve user experience, our Site, our mobile applications, or our Services.
We may use Customer Data to:
- Process transactions between Customers and FanServ
- Send emails about our Site, our mobile applications, or Services or respond to Customer inquiries
- Send emails and updates about FanServ, including newsletters and notifications
We may use User Data to:
- Perform Analytics Services on behalf of Customers
- Perform Targeted Advertising Services on behalf of Customers
- Create, analyze, market, distribute to third parties, and make available for sale aggregated and anonymous targeting segments for digital advertising purposes
- Perform any other function that we believe in good faith is necessary to protect the security or proper functioning of our Site, our mobile applications, or Service
Consents
Customers are responsible for providing End Users with notice and obtaining all applicable End User consents to FanServ’s collection and use of User Data
End User Opt-out
End Users who do not want the FanServ Services to collect any non-identifying information about them may opt-out of such collection by visiting the FanServ Opt-out (http://www.fanserv.com/opt_out_policy) and following the opt-out instructions.
Cookies and Anonymous Identifiers
We use cookies on our Site and our mobile applications,. “Cookies” are small pieces of information or files that a website puts on your computer or device which allow FanServ to collect information about your navigation of the Site or application and ease such navigation. Please note that we may also use third party cookies on our Site and mobile applications, which may result in third parties being able to collect information about you after you have left our Site or applications.
You consent to our use of cookies in relation to your computer system or device. You may be able to change your browser settings to refuse third-party cookies or to indicate when a third-party cookie is being sent. Check your browser’s “Help” files to learn more about handling cookies on your browser.
If you are an End User, we collect and use anonymous device advertising identifiers (random strings of characters that are akin to cookies) to identify your device (but not you individually). Third Party Access to Your Information
We use third party individuals and organizations to assist us in providing Services, including contractors, web hosts, advertising platform and services providers, and others.
Throughout the course of our provision of our Services, we may delegate our authority to collect, access, use, and disseminate non-identifying information to such third parties. You agree that we may provide your information to third parties that we hire, contract, or otherwise retain the services of for the purpose of operating, maintaining, repairing, or otherwise improving or preserving the Services. We may also share information in the form of aggregated, anonymous interest-based targeting segments with third party advertising platforms and networks, to enable targeted advertising services on your applications. You agree not to hold us liable for the actions of any of these third parties, even if we would normally be held vicariously liable for their actions, and you further agree that you must take legal action against them directly should they commit any tort or other actionable wrong against you.
We may disclose your information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
We may share aggregated information publicly and with our partners. For example, we may share information publicly to show trends about the general use of our services. This information cannot be used to identify individuals.
Release of Your Information for Legal Purposes
At times it may become necessary, for legal purposes, to release your information in response to a request from a government agency or a private litigant. You agree that we may disclose your information to a third party where we believe, in good faith, that it is necessary to do so for the purposes of a civil action, criminal investigation, or other legal matter. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either. We may also proactively report you, and release your information to, third parties where we believe that it is prudent to do so for legal reasons, such as our belief that you have engaged in fraudulent activities. You release us from any damages that may arise from or relate to the release of your information to a request from law enforcement agencies or private litigants.
Data Retention
FanServ will retain User Data we collect and process on behalf of our Customers for as long as needed to provide Services to our Customers. FanServ will retain and use certain Customer Data and User Data as necessary to comply with our legal obligations and enforce agreements.
Commercial and Non-Commercial Communications
We may use the contact information you provide to us to contact you about the Site, our mobile applications, Services or any third party products and services you might find interesting. By providing your contact information to us, you waive all rights to file complaints concerning unsolicited email from FanServ. However, you may unsubscribe from certain communications by notifying FanServ that you no longer wish to receive solicitations or information and we will endeavor to remove you from the database.
Security Measures
We take certain measures to enhance the security of our Site, mobile applications and Services, including using SSL Certificates and Vulnerability Scanning. However, we make no representations as to the security or privacy of your information. It is in our interest to keep our Site and mobile applications secure, but we recommend that you use anti-virus software, firewalls, and other precautions to protect yourself from security threats.
Your California Privacy Rights
FanServ permits residents of California to use its Services. Therefore, it is the intent of FanServ to comply with the California Business and Professions Code §§ 22575-22579. If you are a California resident you may request certain information regarding our disclosure of personal information to any third parties for their direct marketing purposes. Various provisions throughout this Privacy Policy address requirements of the Californian privacy statutes. In summary, you must presume that we collect electronic information from all visitors. Minors
Individuals under 18 years of age are not allowed to use our Services. If you become aware of an End User who is under the required age to use our Services, please notify us immediately at info@fanserv.com and provide us with full details as to why you believe they are below that age and we will address the issue. If you are an End User who is reported in this manner, we may require you to provide suitable proof of age, such as a copy of government identification, in order to continue using our Site, mobile applications and/or Services.
International Transfer
Your information may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, FanServ transfers Personal Identifiable Information to the United States and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Third Party Websites
FanServ may post links to third party websites on our Site or mobile applications. These third party websites are not screened for privacy or security issues by FanServ, and you release us from any liability for the conduct of these third party websites.
Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, does not create rights enforceable by third parties or require disclosure of any personal information relating to members of the Services, our Site or mobile applications. FanServ bears no responsibility for the information collected or used by any advertiser or third party website.
